Provisional anticipatory bail is granted subject to bond, sureties and verification of antecedents, with confirmation contingent on the petitioner having no more than two prior cases.

Summary

The petitioner, Nitish Kumar, feared arrest in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act concerning alleged possession of liquor and destruction of Jawa Mahua. He has two prior criminal cases, one of which involves recovery of liquor from a location not owned by him and no seizure from his immediate possession. The petitioner argued that the informant’s identity was omitted from the FIR, casting doubt on the prosecution’s case, and sought anticipatory bail. The State opposed the bail application. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and directed verification of the petitioner’s antecedents, invoking Section 482(2) of the B.N.S.S. If more than two prior cases are found, the bail would not be confirmed; otherwise it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s prior criminal antecedents affect the grant and confirmation of anticipatory bail.

registered for the offence punishable under Section 30(a) of

                   Bihar Prohibition and Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of two cases, out of which, one case is

under the Excise Act and allegation is of recovery of 60 litres of

not arrested from the spot as such nothing was recovered from

his conscious possession and even alleged recovery is from a

the name of the petitioner is not disclosed in the FIR which casts

an aspersion on the case of the prosecution.

                       6. It is made clear that the learned trial court thereafter

shall verify the criminal antecedents of the petitioner and in the

two cases, in that event, it would be presumed that petitioner

had concealed his antecedent before this court, as such, the
