The Court granted bail to the petitioners, subject to conditions.
Summary
The petitioners, Aman and Kaushal, were arrested in connection with the recovery of 8,641.44 litres of foreign liquor from a truck, alleged to be offences under Section 30(a) of the Bihar Prohibition and Excise Act. They claimed innocence, stating they were merely the driver and co‑driver and had no knowledge of the illicit liquor, and that no incriminating material was found on them. The State opposed bail, while the petitioners highlighted their lack of criminal antecedents and the non‑compliance of Section 103 of the BNSS, 2023. Considering the facts, the period of custody since 29‑11‑2025, and the absence of direct evidence, the Court inclined to grant bail. The petitioners were released on bail upon furnishing bonds of Rs.15,000 each with two sureties, subject to conditions of family surety, regular appearance, and possible cancellation on default.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in view of the facts and custody period
