The court granted provisional anticipatory bail to the petitioner, subject to bond, sureties, and verification of his antecedents.

Summary

The petitioner, Sintu Kumar, sought anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for allegedly transporting 73.200 litres of liquor in his Alto car. He argued that he had a clean record, that the liquor was not found in his personal possession, and that he was unaware of his driver’s alleged misuse of the vehicle. The State opposed the bail, contending that the offence warranted arrest. The High Court, considering the petitioner's clean antecedent and the circumstances of the seizure, granted provisional anticipatory bail subject to a modest bond and two sureties, and directed the trial court to verify his criminal record. The order further stipulated that if any antecedent is discovered, the bail would not be confirmed, whereas a clean record would lead to immediate confirmation of the bail.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether ownership of the vehicle used for alleged transport of liquor suffices to justify arrest.
  • Whether the conditions imposed under Section 482(2) of the Criminal Procedure Code are appropriate for provisional anticipatory bail.
