Patna High Court

Sonu Kumar Singh @ Yash BhardawajversusThe State Of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioners, subject to specified conditions.

Summary

The petitioners, Sonu Kumar Singh and Manu Singh, were arrested in connection with the recovery of 889.92 liters of foreign liquor from a truck under Section 30(a) of the Bihar Prohibition and Excise Act. They contended that they were neither the driver nor the owner of the vehicle and that no incriminating material was found in their possession, asserting false implication. The State opposed bail, while the petitioners highlighted the lack of compliance with Section 103 of the BNSS, 2023 and their custody since 14‑12‑2025. Considering the facts, the court found no substantial risk of flight or tampering and decided to grant bail. The petitioners were released on bail of Rs.15,000 each with two sureties, subject to conditions of family surety, regular court appearances, and possible cancellation on default.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in view of the circumstances of arrest and custody.
  • Whether the non‑compliance of Section 103 of the BNSS, 2023, affects the grant of bail.
