Patna High Court

Raushan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted as the recovery of illicit liquor was not made from the petitioner's conscious physical possession.

Summary

The petitioner, Raushan Kumar, was implicated in a case under Section 30(a) of the Excise Act, 2022 for alleged illegal manufacturing and trading of illicit liquor, with 43.200 litres recovered from a motorcycle registered in his name but owned by a friend. He argued that he did not have conscious physical possession of the liquor. The prosecution opposed his bail, noting he was already on bail in another criminal case. The court examined the factual submissions and found that the recovery did not appear to be from the petitioner's conscious possession. Consequently, the court directed that he be released on bail upon surrender within four weeks, subject to a bail bond of Rs. 10,000 with two sureties and conditions under Section 482(2) of the BNSS. The bail order was conditioned on compliance with the exclusive Special Excise Court, Muzaffarpur.

Issues considered

  • Whether the petitioner is entitled to bail when the alleged illicit liquor was not recovered from his conscious physical possession.
  • Whether Section 482(2) of the BNSS permits the grant of bail in this circumstance.
