Patna High Court

Vikash KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner with specified conditions.

Summary

Vikash Kumar, the owner of a motorcycle from which 95 litres of illicit liquor was seized, faced arrest under Section 30(a) of the Bihar Prohibition and Excise Act in Patepur P.S. Case No. 154 of 2023. He applied for anticipatory bail, asserting his innocence and offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the application. The Court, after considering the facts and the petitioner's submission, granted anticipatory bail subject to a Rs. 10,000 bail bond with two sureties, a mandatory donation of Rs. 25,000 to the Ramakrishna Mission Sevashrama, and a requirement to attend the Sarai Police Station on the first and third Sundays of each month. The order also clarified that its observations were prima facie and not to influence the trial. The bail was conditioned under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bihar Prohibition and Excise Act, Section 30(a).
  • Whether the Court may impose a monetary donation as a condition of anticipatory bail.
  • Whether the attendance requirement at the police station is a valid condition for anticipatory bail.
