BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to prescribed conditions.

Summary

The petitioners, Gautam Kumar and Kapildeo Rai, sought anticipatory bail fearing arrest in a case (PS No.19 of 2023) involving the death of an informant's father, alleged to have resulted from pressing his testicles. The prosecution alleged that the accused assaulted the victim and his family with lathis, leading to death, but the post‑mortem report indicated asphyxia due to chest compression and sternum fracture. The petitioners argued that the charge sheet lacked specific allegations against them and that similarly situated co‑accused had already been granted bail. The State opposed the bail, emphasizing the seriousness of the alleged act. The High Court, noting the absence of a specific charge against the petitioners and the general nature of the allegations, granted anticipatory bail under Section 438(2) of the CrPC and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, subject to standard bail conditions.

Issues considered

  • Whether anticipatory bail can be granted when the charge sheet contains only general, omnibus allegations against the petitioners.
  • Whether the cause of death ascribed to chest compression, rather than the alleged testicular pressure, negates the necessity of arrest.
  • Applicability of Section 438(2) CrPC and Section 482(2) Bhartiya Nagarik Suraksha Sanhita in granting anticipatory bail.

Nagar, Begusarai, was feeding his cattle at his house when eight

accused allegedly assaulted the informant and his brothers, Amit

Kumar and Sumit Kumar, with lathis and dandas. When the

informant’s father intervened to rescue them, the accused also

assaulted him with fists and slaps, causing him to fall to the

ground. It is alleged that two of the accused, Hareram Mahto

and Kapildeo Rai, pressed the father’s hydrocele with the

intention to kill him, resulting in his death. The informant

claims that all accused acted with common intention and that the

incident was witnessed by Sundri Devi, Amit Kumar, Sumit

          Kumar, and Babli Kumari.

                      4. Learned counsel for the petitioners submits that the

informant’s father along with one Kapildeo Rai, the matter was

investigated and for lack of evidence, final form is said to have

been submitted by the Police. From perusal of the post-mortem

report, the cause of death is said to be due to asphyxia caused by

dated 04.02.2026 passed in Cr. Misc. No.6302 of 2026.

                      5. Learned APP for the State vehemently opposed the

prayer for anticipatory bail application and submits that there is

serious allegation of pressing the testicles, owing to which death

          has occurred.

                       6. Considering the aforesaid facts and circumstances

that the cause of death is due to asphyxia caused by
