Provisional anticipatory bail is granted, subject to bond, sureties, and verification of antecedent, with confirmation contingent on the number of prior cases.

Summary

The petitioner, Kanhaya Nut, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 105 litres of liquor from a village area not in his possession. He argued that the recovery was made at the behest of a hostile chaukidar and that no material was seized from his conscious possession. The State opposed the bail. The Court, considering the submissions, granted provisional anticipatory bail subject to a Rs.5,000 bond, two sureties, and verification of the petitioner’s criminal antecedent. It directed that if more than one prior case is found, the bail would not be confirmed; if only one prior case, the bail would be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bihar Prohibition and Excise Act.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s prior criminal antecedent affects the confirmation of the provisional anticipatory bail.

                   learned A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of one case under the Excise Act and

                                4. Learned counsel for the petitioner submits that

petitioner was not arrested from the spot, as such, nothing was

recovered from his conscious possession and even the alleged

implicated at the instance of the Chawkidar with whom he is on

an inimical term. It is further submitted that if the Chawkidar

was aware of the involvement of the petitioner in the occurrence
