Bikram Sah @ Bikrama SahversusThe State of Bihar

Holding

The court ordered provisional anticipatory bail with conditions, subject to verification of the petitioner’s antecedents.

Summary

Petitioner Bikram Sah sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act. He has two prior criminal cases, one involving alleged recovery of 8.625 litres of liquor from his jointly owned house, but no liquor was seized from his personal possession. The petitioner argued that the concept of deemed possession was abolished after the 2018 amendment and that the complaint was filed by an inimical chowkidar, casting doubt on the prosecution's case. The State opposed the bail. The High Court granted provisional anticipatory bail on condition of furnishing bail bonds and two sureties, directing the trial court to verify the petitioner’s antecedents; if more than two prior cases are found, the bail will not be confirmed, otherwise it will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in a case under Section 30(a) of the Bihar Prohibition and Excise Act given the facts and his criminal antecedents.
