Holding

The petition for pre‑arrest bail was denied.

Summary

Nitish Singh applied for pre‑arrest bail after being implicated in a case alleging that he misbehaved with and touched the private parts of the informant’s minor daughter. The FIR charges him under sections 115(2), 126(2), 65(2), 351(2), 352 and 3(5) of the BNS and sections 4/8 of the POCSO Act. The victim’s statement recorded under Section 183 of the BNSS was admitted as evidence supporting the prosecution. The Court considered the seriousness of the alleged sexual offences against a minor and the gravity of the accusations. Finding the allegations serious and the victim’s statement credible, the Court rejected the petitioner’s prayer for pre‑arrest bail.
