The Court conditionally granted anticipatory bail, subject to verification of the petitioner’s antecedent, under Section 438 CrPC and Section 482(2) B.N.S.S.
Summary
Ankit Kumar was implicated in a case under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018 for the alleged recovery of 129.60 litres of liquor from a Baleno vehicle he owned. He applied for anticipatory bail, arguing that he had a clean antecedent, that the liquor was not found in his conscious possession, and that he was unaware of any misuse of his vehicle by a third party, Vishal Singh. The State opposed the bail on the ground of the seriousness of the offences. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and conditioned it on verification of the petitioner’s criminal antecedent by the trial court. If the trial court finds any prior case, the provisional bail will not be confirmed; otherwise, it will be confirmed. The order was made under Section 438(2) of the Criminal Procedure Code and Section 482(2) of the Bihar Narcotic Substances (B.N.S.S.) Act.
Issues considered
- Whether anticipatory bail can be granted in a case under the Bihar Prohibition and Excise (Amendment) Act, 2018.
- Whether ownership of the vehicle used in the alleged offence makes the owner liable for anticipatory bail denial.
- Whether the petitioner’s clean antecedent is a condition for confirming anticipatory bail.
