Holding
Provisional anticipatory bail is granted subject to bail bond, sureties and verification of the petitioner’s antecedent.
Summary
The petitioner, Md. Anwar Hussain, was implicated in a case (PS‑Andharamath Case No.181 of 2022) for alleged offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018, involving the recovery of 100.8 litres of liquor from two motorcycles. He applied for anticipatory bail, asserting that he has a clean criminal record, was not in actual possession of the liquor, and was merely the owner of one of the seized vehicles, unaware of its misuse by another individual. The State opposed the bail, contending that the petitioner could be a flight risk or may tamper with evidence. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S. The order further directed the trial court to verify the petitioner’s antecedent; if any prior case is found, the bail would not be confirmed, otherwise it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the circumstances.
- Whether the petitioner’s alleged ownership of the vehicle and lack of possession of liquor justify bail.
- Whether the petitioner’s criminal antecedent, if any, affects the confirmation of bail.
