The Court granted provisional anticipatory bail to the petitioner, subject to bond, sureties, and verification of antecedents.

Summary

The petitioner, Yogendra Kumar, sought anticipatory bail after a case was registered under Sections 30(a), 32(i)&(iii) and 41(i)&(ii) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for alleged recovery of 277.920 litres of liquor from his Scorpio vehicle. He argued that he had a clean antecedent, was not present at the spot of seizure, and was unaware that his driver misused the vehicle, contending that ownership alone should not implicate him. The State opposed the bail, asserting the seriousness of the offences. The Court, considering the petitioner's clean record and the circumstances, granted provisional anticipatory bail subject to a Rs.500 bond, two sureties, and verification of antecedents by the trial court. The order stipulated that if any prior case is discovered, the bail would not be confirmed; otherwise, it would be confirmed immediately.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C. in a case involving alleged possession of liquor in a vehicle he owns.
  • Whether ownership of the vehicle and alleged lack of knowledge of the offence negate criminal liability.
  • Whether the petitioner's clean antecedent warrants grant of anticipatory bail.

recovered from his conscious possession. It is further submitted
