BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to bond and surety conditions.

Summary

Rohit Kumar was arrested in connection with a case (Riga PS Case No. 458 of 2025) alleging possession of 174 litres of illicit liquor, contravening Section 30(a) of the Bihar Prohibition and Excise Act and Section 317(5) of the Bharatiya Nyaya Sanhita, 2023. The petitioner contended that he was merely the driver of the vehicle, had no knowledge of the liquor, and that no incriminating material was found in his possession; he also pointed out a lack of compliance with Section 103 of the BNSS. The State opposed bail, arguing the seriousness of the offence. The Court, after considering the petitioner’s custody period, lack of direct evidence, and his single prior criminal antecedent, decided to grant bail. Bail was conditioned on a bond of Rs.15,000 with two sureties, one of whom must be a close family member, and on the petitioner’s regular appearance before the trial court.

Issues considered

  • Whether bail should be granted to the accused under the provisions of the Bihar Prohibition and Excise Act and the Bharatiya Nyaya Sanhita, 2023.
  • Whether the requirements of Section 103 of the Bharatiya Nyaya Sanhita, 2023, have been satisfied for bail.
