BAIL GRANTED

Holding

The court granted bail to the petitioners, finding no sufficient ground to deny their release.

Summary

The petitioners, Anshu Kumar and Sunil Prasad, were arrested in connection with a case involving the seizure of 63.420 liters of foreign liquor from a shop, alleged to be offences under Section 30(a) of the Bihar Prohibition and Excise Act. They contended that they had no involvement in the shop, no incriminating material was found on them, and they possessed no prior criminal record. The State opposed bail, arguing the seriousness of the offence. The court noted the petitioners' lack of direct possession, the absence of incriminating evidence, their clean antecedents, and the fact that Section 103 of the BNSS, 2023 had not been complied with. Considering these circumstances and the period of custody already served, the court decided to grant bail. The petitioners were ordered to furnish bail bonds of Rs.15,000 each with two sureties of the same amount.
