The court granted provisional anticipatory bail subject to verification of the petitioner’s criminal antecedent, with bond and surety conditions.
Summary
Arif Reza, the owner of a vehicle from which 41.415 litres of liquor was seized, applied for anticipatory bail under Sections 272, 273/34 of the IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. He contended that he had a clean antecedent, was not in conscious possession of the liquor, and was unaware that a third party misused his vehicle. The State opposed the bail, arguing the seriousness of the offences. The Patna High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 with two sureties and directed verification of the petitioner’s criminal antecedent. The order stipulated that if any antecedent is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail is appropriate where the accused is alleged to be the owner of a vehicle from which contraband liquor was seized.
- Whether the petitioner’s claim of clean antecedent and lack of conscious possession justify grant of anticipatory bail under Section 438 of the Cr.P.C.
- Whether the condition of post‑grant verification of criminal antecedent is a valid condition for anticipatory bail.
