Holding

The Court conditionally granted provisional anticipatory bail to the petitioner, subject to verification of his antecedent cases.

Summary

The petitioner, Suresh Kumar, sought anticipatory bail fearing arrest in a case under Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise (Amendment) Act, 2022. He has three prior criminal cases, one involving alleged recovery of 1,120.48 litres of liquor from a rice mill, but no liquor was seized from his possession and the alleged confession was claimed to be made under police pressure. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and directed the trial court to verify the petitioner’s antecedents. If more than three prior cases are found, the bail will not be confirmed; if exactly three, it will be confirmed. The order is subject to Section 482(2) of the B.N.S.S.

Issues considered
