The Court granted provisional anticipatory bail to the petitioner, subject to bail bond, sureties, and verification of her criminal antecedent.
Summary
The petitioner, Savitri Devi, sought anticipatory bail fearing arrest in a case alleging recovery of 61,400 litres of liquor from her residence, alleged to be an offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. She contended that the liquor was stored in a joint family house, she had no conscious possession, and the concept of deemed possession was removed by the 2018 amendment, making the charge untenable. The State opposed the bail, arguing the seriousness of the offence and her prior three excise cases. The Court, after considering the submissions, granted provisional anticipatory bail under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S., subject to a bail bond of Rs.15,000 with two sureties and a verification of her criminal antecedent. The order stipulated that if verification shows more than three prior cases, the bail would not be confirmed; if only three, it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in view of the alleged offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether the amendment removing the concept of deemed possession affects the applicability of the charge.
- Whether the petitioner’s prior three excise cases influence the grant of anticipatory bail.

4. Learned counsel for the petitioner submits that
petitioner was not arrested from the spot, as such, nothing was

was within her knowledge and after amendment in the Excise
Act in the year 2018, the concept of deemed possession and
presumed offender has been done away with. It is next
submitted that petitioner came to be implicated at the instance of
the Chawkidar but then it is submitted that it absolutely does not
stand to reason that how the Chawkidar would known who had
concealed the liquor in the house and if the Chawkidar was
aware of the involvement of the petitioner in the occurrence
then why he did not inform the police prior to the institution of
the instant FIR which casts an aspersion on the case of the
prosecution.
5. Learned A.P.P. for the State opposes the prayer for
anticipatory bail of the petitioner.
6. Considering the submissions made by the learned
counsel appearing on behalf of the petitioner, let the petitioner,
above-named, in the event of her arrest or surrender within a
period of six weeks from today, be released on provisional

under Section 438(2) of the Cr.P.C./482(2) of the B.N.S.S.
7. However, it is made clear that thereafter the learned
Trial Court shall verify the criminal antecedent of the petitioner

provisional anticipatory bail order shall be confirmed forthwith.
