Holding

The Court granted provisional anticipatory bail with conditions, pending verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Gulshan Singh, sought anticipatory bail after the police registered a case under Section 30(a) of the Bihar Prohibition and Excise Act alleging recovery of 703.125 litres of liquor from a public toilet. He argued that he was not arrested on the spot, had no possession of the liquor, and that the chaukidar’s involvement raised doubts about the prosecution’s case. The State opposed the bail, contending the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail subject to a Rs.10,000 bond with two sureties and a requirement to surrender within six weeks, invoking Sections 438(2) of the Cr.P.C. and 482(2) of the BNSS. The order also stipulated verification of the petitioner’s criminal antecedent, with the bail to be confirmed only if he has no more than two prior cases.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. in a case under the Bihar Prohibition and Excise Act
  • Whether the petitioner’s alleged lack of possession and the role of the chaukidar affect the merits of the bail application
