Holding
The Court provisionally granted anticipatory bail subject to verification of the petitioner’s criminal antecedent, with confirmation contingent on the antecedent being limited to a single prior case.
Summary
The petitioner, Alok Kumar Paswan, sought anticipatory bail after a FIR was lodged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018, alleging his involvement in the recovery of 982.4 litres of liquor from a truck. He argued that he was not arrested at the scene, had no conscious possession of the liquor, and was not the owner of the vehicle, claiming he was implicated by a local person who failed to inform police earlier. The State opposed the bail. The High Court granted provisional anticipatory bail conditioned on a Rs.5,000 bond with two sureties, subject to verification of the petitioner’s criminal antecedent. The order stipulated that if the petitioner is found to have more than one prior case, the bail would not be confirmed; if only one prior case is found, the bail would be confirmed immediately.
Issues considered
- What is the appropriateness of granting anticipatory bail to the petitioner under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018?
- Whether the petitioner’s alleged lack of conscious possession and non‑ownership of the seized vehicle justify anticipatory bail?
- Whether the petitioner’s criminal antecedent (one prior case) affects the grant of anticipatory bail?
