Decided

BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to conditions, as he was not in constructive possession of the seized liquor.

Summary

Raja Kumar was implicated in a liquor smuggling case (PS Case No.39 of 2026) after police seized a pickup van containing 1,350 litres of illicit Nepali liquor. The petitioner contended that he was neither the owner nor the driver of the vehicle and had no constructive possession of the seized liquor, arguing that the seizure violated procedural requirements of the Bihar Narcotic Substances Act, 2023. He applied for anticipatory bail, offering to deposit Rs.5,000 in the welfare account of the Patna High Court Advocates' Association. The State opposed the bail. Considering the lack of direct involvement and the petitioner’s antecedent, the court inclined to grant anticipatory bail, subject to a bail bond of Rs.10,000 with two sureties and compliance with Section 482(2) of the B.N.S.S. Act, 2023, and the deposit of the proposed amount. The order released the petitioner on anticipatory bail pending arrest or surrender within four weeks.

Issues considered

  • Whether anticipatory bail can be granted when the accused is not the owner or driver of the vehicle from which illicit liquor was seized
  • Whether the seizure complied with the procedural provisions of the Bihar Narcotic Substances Act, 2023
  • Whether Section 482(2) of the B.N.S.S. Act, 2023 permits the grant of anticipatory bail in such circumstances

Prohibition and Narcotics Control Unit, Patna regarding

transportation of a large consignment of liquor in a pickup van

by alleged liquor smuggler Raja Kumar of village Bihari Gopal

Patti. Acting upon the information, the police reached near

village Bihari Tomar, where they noticed several persons

gathered near a pickup van. On seeing the police vehicle lights,

the persons allegedly fled away taking advantage of darkness.

The police seized the pickup van bearing registration no.

BR06GB-1128 and recovered 30 plastic bags and 150 cartons

containing Nepali country-made liquor, amounting to 4500

recovery has been made from the pick-up van bearing

livelihood by rendering his services as a labour. The search and

          anticipatory bail application.

                       7. Regard being had to the submission made by the
