Patna High Court

Vijay RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner.

Summary

Vijay Rai applied for anticipatory bail after a police case (Town P.S. No. 203 of 2026) was filed under Section 30(a) of the Bihar Prohibition and Excise Act alleging that 250 litres of country-made liquor were recovered from two totos and two motorcycles. The petitioner contended that the vehicles and the seized liquor did not belong to him and that he was being implicated solely on the basis of his antecedents. The State opposed the bail, arguing that the offence was cognizable. The High Court, after considering that the seized articles were not linked to the petitioner, exercised its power under Section 438 of the Code of Criminal Procedure and Section 482 of the Bhartiya Nagarik Suraksha Sanhita to grant anticipatory bail, subject to standard conditions including sureties, appearance before the trial court, and non‑interference with witnesses. The order directed the petitioner to furnish a bail bond of Rs.10,000 with two sureties and comply with the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC and Section 482 of the Bhartiya Nagarik Suraksha Sanhita in a case under the Bihar Prohibition and Excise Act where the seized liquor and vehicles are not owned by the petitioner.
