Patna High Court

Sonu PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to specified conditions.

Summary

The petitioner, Sonu Paswan, sought anticipatory bail in connection with a case (Simri P.S. Case No. 41 of 2026) under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022, where police recovered 10 litres of illicit country-made liquor from an open public place. The petitioner argued that the seized liquor was not linked to him and that his name appeared only due to prior criminal antecedents. The State opposed the grant of anticipatory bail. The Court, after considering that the seizure was from a publicly accessible location and bore no connection to the petitioner, ordered that anticipatory bail be granted subject to a bail bond of Rs.10,000 with two sureties and several conditions, including appearance before the trial court and non‑interference with witnesses. The bail is to be surrendered within four weeks if the petitioner is arrested or surrenders. The order also incorporated conditions under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted when the seized contraband is recovered from an open public place and is not directly linked to the petitioner.
  • Whether the petitioner’s prior criminal antecedents justify denial of anticipatory bail under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.
