The Court granted anticipatory bail to the petitioner, subject to bail bond and surety conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Pompa Choudhuri, mother‑in‑law of an informant from Bangladesh, was implicated in a dowry‑related case (Patliputra P.S. Case No. 383 of 2025) under several sections of the Bharatiya Nagrik Suraksha Sanhita. The informant alleged that the petitioner and her son tortured her for dowry, while the petitioner contended she had already paid Rs.20,000 to the informant and had no involvement in the matrimonial dispute, which is pending before the Family Court. The petitioner, a sick woman with no criminal record, sought anticipatory bail, whereas the State and the informant opposed it, claiming she was evading address disclosure and not supporting the informant. The Court examined the facts, noting the petitioner’s lack of direct involvement and her cooperation with the investigation. It ordered that the petitioner be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S.S., 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bharatiya Nagrik Suraksha Sanhita.
  • Whether the petitioner’s alleged involvement in dowry harassment warrants denial of bail.
