Patna High Court

Balmiki ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to regular bail as he is merely the driver, has no prior record, and the prosecution evidence is insufficient to deny bail.

Summary

The petitioner, Balmiki Chaudhary, was arrested in connection with an excise case (Case No. 67 of 2026) for alleged possession of 210.600 litres of illicit liquor, alleged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He contended that he was merely the driver of the vehicle from which the liquor was seized and had no criminal antecedents, seeking regular bail. The State opposed the bail, arguing the seriousness of the offence. The court examined the FIR and noted the petitioner was not the owner of the vehicle and there were no independent witnesses to the seizure list, while also acknowledging his clean record. Considering these facts, the court held that the petitioner was eligible for bail. Accordingly, the petitioner was ordered to be released on bail upon furnishing a bail bond of Rs. 10,000 with two sureties of the same amount, subject to the satisfaction of the Special Judge, Excise‑I, Rohtas.

Issues considered

  • Whether the petitioner, being only the driver and not the owner, is entitled to regular bail under the provisions applicable to excise offences
  • Whether the absence of criminal antecedents and lack of independent seizure witnesses justify granting bail
