Decided

BAIL GRANTED

Holding

The Court granted bail to the petitioners, directing them to furnish a bail bond of Rs.10,000 each with two sureties.

Summary

Ambuj Kumar and Akash Kumar were arrested in connection with the alleged recovery of 360 litres of illicit spirit from a Tata Panch car, an offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The petitioners contended that they were falsely implicated and that there was no substantive link between them and the seized liquor or vehicle. The State opposed their bail application. After hearing both sides, the Court ordered that the petitioners be released on bail upon furnishing a bail bond of Rs.10,000 each, with two sureties of equal amount, to the satisfaction of the Additional Sessions Judge‑cum‑Exclusive Special Judge, Excise Court No.‑1, Aurangabad. The order effectively secured the petitioners' temporary liberty pending trial.

Issues considered

  • Whether bail should be granted to the accused in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioners were falsely implicated in the alleged illegal liquor offence.
