Patna High Court

Rohit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners, finding insufficient grounds for continued detention.

Summary

The petitioners Rohit Kumar, Kunal Kumar and Abhishek Kumar were arrested in connection with the seizure of 669.63 litres of liquor and charged under Section 30(a) of the Bihar Prohibition and Excise Act. They contended that no liquor was found in their personal possession, the room searched did not belong to them, and they were detained solely on suspicion without any incriminating material. The petitioners also highlighted the absence of compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and pointed out their clean criminal record and the length of custody since 10‑12‑2025. The State opposed the bail application. Considering the lack of direct evidence, the petitioners' clean antecedents and the procedural lapse, the Court inclined to grant bail, directing each petitioner to furnish a bail bond of Rs.15,000 with two sureties of equal amount.
