Patna High Court

Chandan NutversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, finding no sufficient grounds to continue his detention.

Summary

The petitioner, Chandan Nut, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act after 13 litres of liquor were recovered from his residence, which is a joint family house. The petitioner claimed innocence, arguing that no liquor was found in his personal possession and that he was falsely implicated. The State opposed bail, citing the petitioner’s two prior criminal antecedents and the fact that Section 103 of the BNSS, 2023 had not been complied with. The Court examined the facts, the length of custody since 7 December 2025, and the lack of incriminating material directly linking the petitioner to the liquor. Considering these circumstances, the Court decided to grant bail, ordering the petitioner to furnish a bail bond of Rs.15,000 with two sureties of the same amount.

Issues considered

  • Whether the petitioner is entitled to bail under Section 30(a) of the Bihar Prohibition and Excise Act despite prior criminal antecedents and non‑compliance with Section 103 of the BNSS, 2023
  • Whether the recovery of liquor from a joint family house establishes sufficient grounds to deny bail
