Patna High Court

Chotu @ Vivek KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners, finding no sufficient grounds to deny it.

Summary

The petitioners, Chotu and Guddu, were arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 197.52 liters of foreign liquor recovered from three motorcycles. They contended that they were innocent, had no ownership of the motorcycles, and no incriminating material was found on them, also noting the lack of compliance with Section 103 of the BNSS, 2023. The State opposed bail, arguing the seriousness of the offence. The Court, considering the absence of direct evidence, the petitioners' clean record, and the period of custody already served, decided to grant bail. Each petitioner was ordered to furnish a bail bond of Rs.15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in the absence of incriminating material and ownership of the seized motorcycles.
  • Whether the non‑compliance with Section 103 of the BNSS, 2023, precludes the grant of bail.
