Holding
The Court held that the seizure did not meet the statutory thresholds of Sections 103, 105 BNSS nor Section 76(2) of the Bihar Prohibition and Excise (Amendment) Act, 2018, and therefore granted pre‑arrest bail to the petitioner.
Summary
Babita Devi was identified by police after a raid on an open area where 8 litres of illicit wine were recovered, leading to a pre‑arrest bail application in connection with PS case No. 146 of 2026 under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner argued that the seizure was from an open, publicly accessible place, violating mandatory provisions of Sections 103 and 105 of the BNSS, and that no material justified invoking the stringent provisions of Section 76(2) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The State contended that the petitioner was involved in the sale of illicit wine and opposed bail. The Court examined the statutory requirements and found that the recovery did not satisfy the conditions of Sections 103, 105 BNSS nor the rigors of Section 76(2), and therefore there was insufficient ground to deny bail. Consequently, the Court ordered that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
Issues considered
- Whether the seizure of illicit wine from an open place violates Sections 103 and 105 of the BNSS, rendering the petitioner ineligible for pre‑arrest detention.
- Whether the facts attract the stringent provisions of Section 76(2) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
- Whether bail should be granted to the petitioner pending trial.
