Rupak Kumar @ Rupak Kumar RayversusThe State of Bihar

DISPOSED

Holding

The court ordered provisional anticipatory bail for the petitioner, subject to verification of his criminal antecedents and compliance with bail conditions.

Summary

The petitioner, Rupak Kumar Ray, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for allegedly possessing 6.75 litres of liquor recovered from his house, which is a joint family property. He argued that he was not arrested, the liquor was not in his conscious possession, and the concept of deemed possession had been removed by the 2018 amendment. The State opposed his request for anticipatory bail. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.10,000 and two sureties, and directed the trial court to verify his criminal antecedents. If more than two prior cases are found, the bail would not be confirmed; if only two, it would be confirmed immediately.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s alleged possession of liquor can be established given the joint family ownership of the house and lack of arrest.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
