Munna Yadav and OrsversusState Of Bihar and Anr

Decided
Disposal
DISPOSED

Holding

Since the petitioners and the State agreed that the proceedings were infructuous, the Court disposed of the petition without further inquiry.

Summary

The petitioners sought quashing of an order dated 07-04-2018 passed by the Judicial Magistrate‑I, Buxar, which had taken cognizance under Section 323 of the Indian Penal Code against all petitioners and additionally under Section 379 IPC against petitioners 1 and 2. The petition argued that the proceedings had become infructuous and should be disposed of. The State, represented by the Assistant Public Prosecutor, raised no objection to the petitioners' request. The Court, after hearing both sides, accepted that the matter was indeed infructuous. Consequently, the Court disposed of the petition, noting that no further adjudication was necessary.
