The court allowed the anticipatory bail application, granting provisional anticipatory bail subject to a bail bond, sureties, and verification of antecedents.

Summary

Shashi Bhushan Singh applied for anticipatory bail after the police registered a case against him under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging that 750 ml of liquor was recovered from a guardroom in DRCC premises. The allegation is based solely on a confessional statement made by another accused, Awadhesh, while in police custody, and no liquor was found in the petitioner's possession. The petitioner argued that the recovery was from a place not belonging to him and that the statement lacks evidentiary value. The High Court, after hearing the petitioner's counsel, directed that provisional anticipatory bail be granted on a bail bond of Rs.5,000 with two sureties, subject to Section 482(2) of the CrPC and verification of the petitioner's criminal antecedents. The order further stipulated that if the petitioner is found to have more than one prior case, the bail would not be confirmed; otherwise, it would be confirmed immediately. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 where the only evidence is a confessional statement of another accused.
  • Whether the petitioner's criminal antecedent affects the confirmation of anticipatory bail.
