Holding
The court ordered the release of the petitioner on bail upon furnishing the prescribed bond and sureties.
Summary
The petitioner, Sanjay Sahani, was charged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for alleged recovery of 300 litres of liquor and 800 litres of semi‑prepared liquor that were destroyed at a river bank. He has four prior cases under the Excise Act and has been in custody since 31‑01‑2026. The petitioner argued that he was not arrested at the spot, no liquor was found in his possession, and his implication was based solely on the complaint of a local person without proper investigation. The State opposed the bail application. The court, after considering the submissions, ordered the petitioner’s release on bail upon furnishing a bond of Rs.5,000 with two sureties of the same amount, directing compliance with the trial court’s conditions.
Issues considered
- Whether bail should be granted to an accused under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 despite prior cases and alleged involvement in large‑scale liquor recovery.
- Whether the absence of seizure of the alleged liquor from the accused’s possession justifies denial of bail.
- Whether the investigation and arrest were conducted in a mechanically driven manner, affecting the bail decision.
