Holding

The court ordered the release of the petitioner on bail with specified bond and surety conditions.

Summary

The petitioner, Chandan Kumar, was arrested in connection with a kidnapping case (Hilsa P.S. Case No. 572 of 2025) under Section 96 of the Bharatiya Nyaya Sanhita. The prosecution alleges that he kidnapped a girl, while the victim’s statement indicates that she eloped with the petitioner. The petitioner, represented by Mr. Manoj Kumar, pleaded innocence and sought regular bail, having been in custody since 26‑08‑2025. The State, through APP Mr. Md. Matloob Rab, opposed the bail application. The High Court, after considering the facts and submissions, granted bail on the condition of a Rs.10,000 bond and two sureties, subject to the satisfaction of the 7th District Judge‑cum‑Special Judge, POCSO, Biharsharif, Nalanda. The court clarified that its order is limited to bail and does not prejudice the merits of the trial.
