Patna High Court

Suraj kumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that the petitioner is entitled to bail on furnishing the prescribed bond and sureties, subject to conditions, despite the prosecution’s objections.

Summary

The petitioner, Suraj Kumar, was arrested on 31‑08‑2025 in connection with a kidnapping case (PS Chiraiya Case No. 366/2025) under Sections 96 and 3(5) of the B.N.S. He sought bail, claiming a clean antecedent and that the FIR was false, delayed, and the victim’s statement under Section 183 of the B.N.S.S., 2023 did not allege sexual assault and she refused medical examination. The informant and the State opposed bail, relying on the victim’s statement that the petitioner abducted her. The Court examined the delay in filing the FIR, the nature of the victim’s statement, and the petitioner’s criminal record, and decided to grant bail on a bond of Rs 10,000 with two sureties, subject to conditions of cooperation, non‑tampering with evidence, and verification of antecedents. The order directed the lower court to release the petitioner on bail and to enforce the stipulated conditions.

Issues considered

  • Whether the petitioner is entitled to bail despite the prosecution’s opposition and the alleged kidnapping charges.
  • Whether the five‑day delay in filing the FIR and the victim’s statement under Section 183 affect the grant of bail.
  • Whether the petitioner’s alleged clean antecedent and the lack of medical examination of the victim justify bail.
