Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a bond and sureties.

Summary

The petitioner, Dhiraj Kumar Singh, was charged under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged recovery of 2,395.5 litres of liquor from an abandoned house belonging to the late Maksudan Mahto. The petitioner was not arrested at the scene, no liquor was found in his possession, and the allegation arose solely from the testimony of a chowkidar, raising doubts about the prosecution's case. He has seven prior criminal cases, two of which are under the Excise Act, and has been in custody since 26‑08‑2025. The petitioner sought bail, arguing lack of direct involvement and questioning why the chowkidar did not inform police earlier. The court, after considering the submissions, granted bail on the condition of a Rs.10,000 bond and two sureties of the same amount.
