Holding
The court held that the search and seizure were defective and the petitioner is entitled to bail.
Summary
The petitioner, Sikindar Sahani, sought pre‑arrest bail after police raided a village in East Champaran and seized 260 litres of illicit country‑made liquor and raw materials in connection with an offence under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner contended that the search and seizure violated Sections 103 and 105 of the Bihar Narcotic and Smuggling Act, lacked independent witnesses, videographic evidence, and was conducted in an open area, rendering the identification unreliable. The State argued that the large seizure and the petitioner’s prior criminal antecedents indicated his complicity. The court examined the procedural defects in the seizure and noted the absence of ingredients required under Section 76(2) of the Bihar Prohibition and Excise (Amendment) Act, concluding that the evidence was insufficient to deny bail. Accordingly, the court granted bail subject to a bond of Rs.20,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
Issues considered
- Did the police conduct the search and seizure in compliance with Sections 103 and 105 of the Bihar Narcotic and Smuggling Act?
- Is the seized liquor and the identification of the petitioner sufficient to justify denial of bail under Section 30(a) of the Bihar Prohibition and Excise Act?
- Is the petitioner entitled to bail under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 given the procedural deficiencies?
