Holding
The Court refused to grant anticipatory bail to the petitioner, holding that the material on record indicates his involvement in the alleged cyber fraud.
Summary
Badal Kumar petitioned for anticipatory bail after the police alleged his involvement in a cyber‑fraud scheme investigated under Sections 318(4), 112 and 3(5) of the B.N.S., 2023 and Sections 66(C) and 66(D) of the Information Technology Act. The prosecution’s case is based on statements of co‑accused Hira Kumar and Sidharth Kumar, who claimed Badal withdrew money from their bank accounts and participated in the fraud. Badal’s counsel argued that he merely withdrew funds on his brother’s instructions, had no knowledge of the fraud, and possesses a clean record. The State contended that Badal is a member of the fraudulent gang and his name appears in the co‑accused’s confessional statements. After reviewing the material, the Court found sufficient material to infer Badal’s participation and declined to grant anticipatory bail. Consequently, the petition for anticipatory bail was rejected.
Issues considered
- What is the appropriate exercise of discretion by the Court in granting or refusing anticipatory bail in a cyber‑fraud case?
- Whether the statements of co‑accused and the recovered bank documents sufficiently link the petitioner to the alleged offences under the B.N.S., 2023 and the IT Act.
