The court inclined to grant bail to the petitioners.
Summary
Manish Kumar and Sikandar Paswan were arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act after 113.73 litres of liquor were recovered from a vehicle they were driving. They claimed they were unaware of the illicit liquor and that no incriminating material was found on them, also noting the lack of compliance with Section 103 of the BNSS, 2023. The State opposed bail, but the court considered the absence of prior criminal records, the short period of custody since 20‑11‑2025, and the petitioners’ alleged innocence. The court therefore granted bail, imposing a bond of Rs.15,000 with two sureties and conditions of regular appearance. The order released the petitioners on bail subject to the stipulated conditions.
Issues considered
- Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the non‑compliance with Section 103 of the BNSS, 2023, warrants denial of bail.
- Whether the custody period and lack of incriminating material justify bail.
