Patna High Court

Ranjit RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, subject to bond and conditions.

Summary

Ranjit Rai was named in an FIR for allegedly participating in stone‑pelting against police during a protest in Ahiyapur, Muzaffarpur, and was charged under several IPC sections (147, 148, 149, 332, 333, 353, 307, 186) and Section 27 of the Arms Act. The petitioner contended that the charges were vague, that he was not specifically identified as having a role, and that a similarly situated co‑accused had already been granted bail, warranting parity. The State opposed bail. The Court observed that the allegations were indeed general and omnibus, noted the precedent of bail to a co‑accused, and therefore ordered the petitioner’s release on bail subject to a bond of Rs.10,000 with two sureties and conditions under CrPC Section 438(2) and BNSS Section 482(2).

Issues considered

  • Whether the petitioner is entitled to bail despite the serious charges under the IPC and Arms Act.
  • Whether the general and omnibus nature of the allegations precludes granting bail.
  • Whether parity with a similarly situated co‑accused who was granted bail mandates the same relief.
