Holding
The court held that the petitioner is entitled to bail, subject to a bond of ₹30,000 and the conditions stipulated under the Bharatiya Nagrik Suraksha Sanhita, 2023.
Summary
The petitioner, Ranjeet Kumar Singh, sought bail in connection with a criminal case (PS Case No‑27 of 2026) alleging offences under sections 126(2), 115(2), 109(1), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The FIR alleged that the petitioner and another accused assaulted the informant with an iron rod, lathi and danda, causing serious injuries. The petitioner’s counsel argued that the dispute was a long‑standing land conflict between the parties, that the alleged incident occurred in a maize field where a fire was set, and that similar disputes had arisen earlier, but the petitioner was willing to comply with any bail conditions. The State opposed bail, contending that both parties were “gotiya” and that the existence of a case and counter‑case indicated a serious offence. After considering the facts, the court ordered that the petitioner be released on bail upon furnishing a bond of ₹30,000 and complying with conditions under Section 2(1)(d) of the Bharatiya Nagrik Suraksha Sanhita, 2023 and Section 482(2) of the same Act.
Issues considered
- Whether bail should be granted to the petitioner despite the serious nature of the offences alleged under the Bharatiya Nyaya Sanhita, 2023.
- Whether the petitioner’s prior criminal antecedents and the existence of a case‑and‑counter‑case bar the grant of bail.
- Whether the conditions prescribed under the Bharatiya Nagrik Suraksha Sanhita, 2023 are sufficient to justify bail.
