BAIL GRANTED

Holding

The petitioner is entitled to anticipatory bail under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023, subject to the stipulated conditions.

Summary

Awadhesh Ray sought anticipatory bail fearing arrest in a case (Dariyapur P.S. Case No. 651 of 2025) under Sections 30(a), 34, 36 and 41(1) of the Bihar Prohibition and Excise Act, where 140 litres of liquor were recovered from a motorcycle and a co‑accused's house. The petitioner contended that he was neither the owner nor the driver of the vehicle, had no criminal antecedent, and that the prosecution had not complied with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed the bail. The Court, after considering the submissions, granted anticipatory bail on the condition that the petitioner surrenders within six weeks, furnishes a bail bond of Rs. 15,000 with two sureties of equal amount, and complies with the conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner in the present case.
  • Whether the petitioner is liable under the provisions of the Bihar Prohibition and Excise Act.
  • Whether the requirements of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023 have been complied with.
