Holding

The petitioner is entitled to regular bail subject to a bond of Rs.10,000 and two sureties.

Summary

Santosh Kumar was arrested in connection with offences under Sections 103(2) and 3(5) of the B.N.S., alleged to have assaulted the husband of an informant, who later died. The petitioner claimed innocence, asserting that he was falsely implicated due to a prior dispute and that there was no external injury found in the post‑mortem. He had no prior criminal record and had been in judicial custody since 16‑Oct‑2025. The State and the informant opposed bail, but the court considered the clean antecedent, the nature of the investigation, and the period of custody already served. The court ordered that the petitioner be released on regular bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, to the satisfaction of the Judicial Magistrate, Bettiah.

Issues considered

  • Whether the petitioner is entitled to regular bail for offences under Sections 103(2) and 3(5) of the B.N.S. given the facts of the case.
