The court granted bail to the petitioner subject to a bond of Rs.30,000 and conditions under the B.N.S.S., 2023.
Summary
Shaili Devi, the owner of a tempo, was implicated in an excise case (Case No. 449 of 2025) for the alleged recovery of 116 litres of illicit liquor, alleged under section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The petitioner contended that she had no conscious possession of the liquor and that her name appeared only because she owned the seized vehicle, asserting a clean antecedent. The State opposed her bail application. The High Court, after considering the facts, granted bail on the condition of a Rs.30,000 bond under Section 2(1)(d) of the B.N.S.S., 2023 and the conditions of Section 482(2) of the same Act, directing the trial court to verify any criminal antecedents. The order also warned that concealment of antecedents would lead to cancellation of bail. The bail is to be surrendered within four weeks if arrested or surrendered before the trial court.
Issues considered
- Whether bail should be granted to the accused in an offence punishable under section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether ownership of the seized tempo suffices to implicate the petitioner in possession of illicit liquor.
- Whether the conditions prescribed under the B.N.S.S., 2023 are satisfied for granting bail.
