Anticipatory bail is granted to the petitioner subject to the conditions imposed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Summary
The petitioner, Salok Kumar, sought anticipatory bail in a case alleging offences under IPC sections 461, 379, 420, 427, and 411/34 related to an alleged ATM robbery. The prosecution’s case was based on a raid following a Mumbai Vigilance tip, during which co-accused were arrested and a sum of Rs 20,000 and a steel weapon were seized. The petitioner claimed innocence, asserting that his name surfaced only through a co-accused’s confessional statement and that no stolen money was found on him. The State opposed the bail application. The Court, after considering the material on record and the circumstances, granted anticipatory bail, directing the petitioner to surrender within eight weeks and to furnish a bail bond of Rs 10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
