Patna High Court

Akhilesh Kumar @ Akhilesh Thakur @ Aklesh ThakurversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to bail as there was insufficient material to justify continued detention.

Summary

The petitioner, Akhilesh Kumar, was arrested in connection with a case registered under Sections 137(2), 96, 3(5) of the BNS and Section 08/12 of the POCSO Act, alleged to have abducted a minor. He had been in custody since 21 January 2025. The petitioner’s counsel argued that the allegations were false and that the victim had voluntarily eloped with him, asserting his innocence. The court examined the bail application, considering the nature of the alleged offence and the claim of false implication. Finding no compelling reason to deny bail, the court ordered his release on condition of a bail bond and sureties. The order was pronounced by Justice Sandeep Kumar on 25 March 2026.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences under the BNS and POCSO Act
  • Whether the allegations of abduction constitute a ground to deny bail
  • Whether the claim of false implication and voluntary elopement of the victim affects the bail decision
