Holding
The Court granted anticipatory bail to the petitioner, subject to a bail bond and sureties.
Summary
Manoj Shankar Gandhi, a DGM posted at Bihta Airport Project, was accused in a 2015 complaint (Case No. 3141(C) of 2015) of mental and physical cruelty under Section 498A IPC and Section 85 of the Bhartiya Nyay Sanhita. The petitioner contended that the marriage had been dissolved by a Family Court judgment on 20 February 2018 and that the parties had been living separately since May 2008, rendering the complaint harassing and irrelevant. He also highlighted that the complainant had been regularly withdrawing maintenance of Rs. 5,000 since 2011, a matter still pending before the court. The State’s Additional Public Prosecutor could not refute these factual submissions. Accordingly, the Court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties, subject to conditions under Section 438(2) Cr.P.C. and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the circumstances.
- Whether the 2015 complaint under Section 498A IPC and Section 85 B.N.S. is bona fide given the prior separation and divorce.
- Applicability of Section 438(2) Cr.P.C. and Section 482(2) B.N.S.S. in granting bail.
