Decided

BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Parmanand Mandal, was arrested in connection with a case alleging possession of 378 litres of Nepali liquor, contravening Section 30(a) of the Bihar Prohibition and Excise Act. The prosecution claimed the liquor was recovered from a jute sack in an open field, while the petitioner asserted innocence, stating no incriminating material was found in his possession and that the allegation stemmed from a local chowkidar's identification. The petitioner had been in custody since 31‑12‑2025 and possessed a prior criminal antecedent, and the State argued against bail. The court noted the lack of direct evidence, the open‑field recovery, and the non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and consequently decided to grant bail. The bail was set at a bond of Rs.15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act considering the facts and the non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023
