Patna High Court

Sanjay Singh @ Sanjay Kumar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond, sureties and compliance with section 482(2) of the BNS.

Summary

The petitioner, Sanjay Singh, sought bail in a dowry death case registered under sections 80 and 3(5) of the Bharatiya Nagarik Suraksha Sanhita (BNS). He asserted that he is the father‑in‑law of the deceased, has a clean antecedent, and is not involved in the alleged torture and murder, which the prosecution attributes mainly to the husband who is already in custody. The State opposed the bail on the ground of the seriousness of the offence. The Court, after considering the petitioner’s clean record and the fact that the principal accused is already detained, ordered that bail be granted on the condition of a Rs.10,000 bond with two sureties and compliance with section 482(2) of the BNS. The bail order is subject to the petitioner surrendering within eight weeks and fulfilling the stipulated conditions.

Issues considered

  • What is the appropriateness of granting bail to the petitioner under sections 80, 3(5) and 482(2) of the Bharatiya Nagarik Suraksha Sanhita in a dowry death case?
  • Does the petitioner’s clean antecedent and lack of direct involvement justify bail despite the seriousness of the alleged offence?
